Here are 6 things your lawyer will look out for in your contract that could save you a lot of pain in the long run. Your lawyer will:
- Assess the remuneration being offered to see if it meets the statutory minimum of wages in Kenya;
- Pick out terms and conditions in the contract that are illegal and would be a disadvantage to you. For example "Clause X : An employee is not entitled to any pay if they are sick and cannot attend work." ;
- Ensure that your employment contract includes annual leave, maternity leave, sick leave and holiday pay with adequate time frames and payment scales;
- Look into the mode of contribution by both you and your employer for the nationwide schemes catering for healthcare (NHIF) and pension (NSSF).
- Ensure that the terms and conditions around termination of employment are CLEAR, ACCURATE and within Kenyan law.
- Discuss with you any other clauses particular to your job description that might be important to you. For example, if your job requires you to work outside of Kenya OR if your job entails you handling dangerous equipment or machinery.
